We do not request sensitive personal data. Please do not share it in lessons or messages.
Primary purposes (needed for the service): create and manage your account; schedule and deliver lessons; record lessons so you can review them; process payments, credits and tutor payouts; review and manage tutor applications; provide support; prevent fraud and keep the platform secure; meet legal obligations.
Secondary purposes (optional): send newsletters, promotions and surveys; produce site usage statistics to improve the site.
To opt out of secondary purposes, email hello@fluencyabc.com or use the unsubscribe link in our emails. Opting out does not affect the services you buy.
Our services are directed to adults. Anyone under 18 may use the service only with the consent and under the supervision of a parent or legal guardian, who registers and pays. We do not verify users' ages. If you are a parent or guardian, you can contact us at hello@fluencyabc.com to access or delete the data of a minor in your care. We do not knowingly collect data from children under 13 without a parent's or guardian's consent; if we learn that we have, we will delete it.
Live lessons take place in the LessonSpace virtual classroom and may be recorded (audio, video and whiteboard content) so the student can review them, and for handling disputes and safety. Recordings are kept for 90 days and then deleted. You can ask us to delete a recording sooner by emailing hello@fluencyabc.com.
We share data with providers that perform services for us and may use it only for that purpose:

Your data may be processed on servers in the United States and other countries where our providers operate. We also share with the tutor you book the data needed to teach the lesson (name, time zone, lesson history and messages); our tutors may live outside Mexico. These transfers are necessary to perform our contract with you and therefore do not require your consent (Art. 37 LFPDPPP). We may also share data with authorities when the law requires it. We do not sell your personal data.
You may access, correct or delete your data, or object to its processing (ARCO rights), and you may withdraw consent or limit the use or disclosure of your data. Send your request to hello@fluencyabc.com with: your name and account email; proof of identity (or of legal representation); a clear description of the data and the right you want to exercise; and anything that helps us locate it. We will reply within 20 business days and, if your request is granted, act on it within 15 business days after that. You can also request deletion of your data from within the platform. To limit advertising, you can register with PROFECO's do-not-advertise registry (REPEP).
We keep your data while your account is active and afterwards for as long as needed to meet legal and tax obligations and resolve disputes, then delete or anonymize it. Recordings are kept as described in Section 5. We apply reasonable administrative, technical and physical safeguards.
We use cookies needed for the site to work (session, language, currency, time zone and your cookie choices). Google Analytics runs only if you accept it in the cookie notice. See the Cookie Policy at https://www.fluencyabc.com/es/cms/view/6.
If you live in a U.S. state with privacy laws, such as California, you may ask to access, correct or delete your personal data and to know what we process, and you won't be discriminated against for exercising these rights. Email hello@fluencyabc.com. We do not sell personal data or share it for cross-context behavioral advertising. We do not knowingly collect data from children under 13 without a parent's or guardian's consent, and we delete it if discovered (see Section 4).

If you believe your data protection rights have been violated, you may contact the competent personal data protection authority in Mexico (Secretaría Anticorrupción y Buen Gobierno, Mexico's Anti-Corruption and Good Governance Ministry, under the Federal Law on the Protection of Personal Data Held by Private Parties published in the DOF on March 20, 2025).
